Smugglers Run on the River: Purchase Policy
Smugglers Run on the River wants to make your ticket purchasing experience as simple, efficient, and equitable as possible to better your live entertainment experience. Our ticket purchasing policy was designed to help us ensure your satisfaction and understanding of the ticket buying process on our website, including and without limitation https://smugglerswyandotte.com (effectively, the “Site”). This purchase policy applies to any and all purchases on this Site made on or after April 1, 2022, including primary ticket sales.
All Smugglers Run on the River tickets for live events, entertainment, or other acts are sold in U.S. Dollars.
2. Accepted Payments
We accept several methods of payment to accommodate your needs, including American Express, Visa, MasterCard, Discover and Apple Pay.
3. Ticket Availability and Pricing
Because we sell tickets for many different artist and events, ticket prices may vary. Each event has a set number of tickets available. Therefore, once the event is sold out, you will no longer be able to purchase.
4. Order Processing and Order Confirmation
Once we send you a confirmation, in the form of a confirmation page or email [“Order Confirmation], your order will be confirmed.
If an Order Confirmation is not received after submitting your final payment, or if you receive an error message or service interruption after submitting payment details, it is your responsibility to confirm via your account whether your order has been placed. Only you may become aware of any issues that occur during your purchase process. We will not be responsible for losses (monetary or otherwise) if you assume an order was placed successfully and you failed to receive confirmation. If you do not receive your ticket but your credit card was charged, please call Smugglers Run on the River for assistance.
5. Opening Acts / Festival Acts
Headlining performers sometimes tour with opening acts, guests, or undercards (each an “Opening Act”). The presence of an Opening Act is not always made known to us, nor is the length of their performance. Opening Acts, as well as any festival performers, are subject to change or cancelation at any time without notice. No refund will be given if an Opening Act or festival performer is changed or canceled.
6. Canceled, Postponed, Rescheduled, and Moved Events
Events may be canceled, postponed, rescheduled to a different time, or moved to a different venue.
In the event of a cancelation: you will not need to take action to obtain a refund; we will issue a refund to the original method of payment used at the time of purchase.
In the case of a reschedule, postponement, or move to another date: your ticket(s) are still valid, and no further action is required. However, the Smuggler Run on the river may approve refunds or the option to choose between a refund or credit for the event. Any refund or credit for the event is determined on an event-by-event basis and may be subject to limitations. We will send you a notification outlining your options in the case that Smugglers on the Run approves refunds and/or credits; you may also submit a request for a refund or credit. Alternatively, you may also choose to keep your ticket(s) to the postponed, moved, or rescheduled event.
If the event you purchased tickets to is canceled, rescheduled, postponed, or moved, we will attempt to contact you to update you on the status of the event, and to inform you of any refund, credit, or exchange procedures. For more instructions on any specific canceled, postponed, rescheduled, or moved event, please check the event information online and in your account (which will include the most current information on the status of the event), or contact us.
Smugglers Run on the River will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event.
7. Refunds, Credits, and Exchanges
All sales are final. Refunds are only allowed in limited circumstances as explained in the Canceled, Postponed, Rescheduled, and Moved Events section above. Carefully review your ticket details such as the date before purchasing your tickets. Smugglers on the River generally set policies that prohibit us from issuing exchanges or refunds after a ticket has been purchased, lost, stolen, damaged, or destroyed. Therefore, tickets cannot be replaced if they are lost, stolen, or damaged.
Refunds: Should you be eligible for a refund and funds have been received from Smugglers on the River, we will issue a refund of the ticket price you paid (or discounted price if you purchased a discounted ticket), any service fees, and any additional add-ons or upgrades—such as parking. At no time will expedited shipping charges, merchandise purchases, Fan Club membership fees, or any other amounts be refunded.
In the event a refund is issued, it will be processed to the original method of payment used at the time of purchase. We cannot issue a refund to a different credit or debit card (this includes refund requests made through the self-service option). If your credit or debit card has changed but is still for the same account, the refund will be processed to that account.
If there is an account(s) that has outstanding balances owed to Smugglers Run on the River, Smugglers Run on the River reserves the right to hold all refunds for said account(s) until such time as no outstanding balances remain.
Merchandise: Merchandise purchases are final, and will not be refunded, exchanged, or offered credits for in any event.
Chargebacks and Other Refund Prohibitions: Regarding tickets you purchased, you agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner. Without limiting the generality of the foregoing, you will not contact us to seek either a refund or exchange from us. You will not dispute or otherwise seek a “chargeback” from the company whose credit card or other methods of payment you used to purchase tickets from the Site. Your tickets are subject to immediate cancelation, and we may, in our sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit future purchases from all persons in whose name the credit card accounts exist, and from any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site if you should do so.
8. Verification: Account, Order, and Billing Information
The information you provide on all accounts and orders must be valid and are subject to verification. All orders are subject to credit card approval. Credit card purchases are only processed after the billing address associated with your credit card and all other billing information have been verified. If any information is found to be false, misleading, incorrect, incomplete, or cannot be verified as belonging to the account holder (like name, address, email address, phone number, IP address, or other account or billing information) on any placed order, then that order is subject to cancelation at any time. And if your order is canceled due to foregoing reasons, we hold the right to sell your tickets to another customer without further notice.
9. Incorrect Pricing and Other Errors
If you pay an incorrect amount for your ticket (regardless of whether it’s incorrect due to an error in a posted price on our Site or otherwise communicated to you), if you’re able to order a ticket before its scheduled on-sale or presale date, or if you ordered a ticket that was not supposed to have been released for sale yet, then we hold the right to cancel that ticket or the order for that ticket and refund you the amount which you paid. Whether the error occurred because of human error or because of a transactional malfunction of the Site or other Smugglers Run operated system, the above stated will still apply. We are not and will not be liable for any travel or other expenses you or anyone else incurs in connection with errors of this nature. We also reserve the right to recharge the original method of payment used at the time of purchase if a refund is processed in error or a refund exceeds the original amount paid.
10. Multiple Browser Windows
Please ensure you use a single browser when looking for and placing an order for an online ticket with us. Searching for tickets using multiple browser windows could result in losing your tickets, errors occurring during the purchase process, or timer expiration.
11. Limitation of Liability
Despite several safety protocols put in place, an injury may occur at any time during an event. Please, always stay alert before, during, and after any given performance. If injured, immediately ask an employee for help or to contact medical professionals. You voluntarily assume all risks and danger incidental to the event for which the ticket is issued, whether it occurs before, during, or after the event performance, and you waive any claims for personal injury or death against us, management, facilities, leagues, artists, other participants, and all our respective parents, affiliated entities, agents, officers, directors, owners, and employees on behalf of yourself and any accompanying minor. You bear all risks of inclement weather. Event date and time are subject to change.
When it comes to the risk of contracting communicable diseases or illnesses, you assume all risks, hazards, and dangers. This includes—without limitation—exposure to COVID-19 or any other bacteria, virus, or another pathogen capable of causing a communicable disease or illness, whether that exposure occurs prior to, during, or post performance or event, and regardless of how caused or contracted. You hereby waive all claims and potential claims against Smugglers Run on the River and the Event Organizer—and against any companies affiliated with Smugglers Run on the River—relating to such risks, hazards, and dangers.
12. License; Ejection and Cancelation; No Redemption Value
You agree to comply with all the Smugglers Run on the River applicable rules, policies, terms, and conditions. Smugglers Run on the River has the right to refuse admission to, or eject, any person whose conduct is deemed disorderly, who uses vulgar or abusive language, or who fails to comply with Smugglers Rin on the River Rules, without refund of any amount paid. Any breach of these terms or rules will terminate your license to attend the event without a refund. A ticket is a revocable license and admission may be refused. Tickets are not redeemable for cash.
13. Exhibition, Recording, and Transmission
You agree the event you purchased tickets for is a public event, that your appearance and actions both inside and outside the event venue are public in nature, and that you have zero expectations of privacy regarding your actions or conduct at the event. You grant permission to us, Smugglers Run on the River, our partners, licensees and assigns, including but not limited to our brand and media partners, to use your image, likeness, name, acts, movements, appearances, plays, and statements in any live or recorded audio, video, or photographic display or another transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during, or after the event) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, your or anyone acting on your behalf. For virtual events, you can view the virtual event solely for your own personal purpose. You may not record, copy, publicly exhibit, transmit, or distribute any virtual event through any means, allow others to log into your account for the purpose of viewing a virtual event, or resell views of any virtual event.
14. You Are Subject to Search
You and any belongings you may hold can be searched upon entry to the event. You consent to such searches, and you waive any related claims that may arise. If you do not consent to such a search, you may be denied entry to the event without a refund or other compensation. Certain items may not be allowed into the premises under certain venue rules, such as (but not limited to) firearms, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants, bundles, and containers.
15. Unlawful Resale of Tickets; Promotions
In the event of unlawful resale or attempted unlawful resale, such as (but not limited to) counterfeit or copy of tickets, may result in seizure and cancelation without compensation. We cannot be responsible for providing legal advice regarding the resale or pricing of tickets, as certain maximum resale premiums and restrictions may apply in some states. You and you alone are responsible for complying with all applicable ticket resale laws. We also reserve the right to restrict or deny ticket purchasing privileges to anyone we deem to be, or to have been, in violation of our policies. Because we do not guarantee the authenticity of tickets purchased from a non-authorized third-party reseller, we recommend that purchases only be made directly through us, any authorized partners, or from the venue box office to ensure ticket authenticity. You may not use your ticket for advertising, promotions, contests, or sweepstakes, without a formal written authorization given by us.
